these general terms and conditions of sale apply exclusively between sas itd (hereinafter “we”) and any person visiting or making a purchase via the website www.Fontenay.Paris.Com (hereinafter “you”). They also contain the fontenay paris warranty policy.

Any internet user can read the general terms and conditions of sale on the website Fontenay.Paris (hereinafter the “site”).

The version of the general terms and conditions of sale applicable to the customer is the one appearing on the site at the time of the customer’s order validation. The different versions of the general terms and conditions of sale are archived by itd company.

Conditions for placing an order

• you declare that you are a natural person at least 18 years old and have the legal capacity or parental authorization allowing you to place an order on the site.

• You are fully authorized to use the payment card for your order and it gives you access to sufficient funds for the full payment of your order.

If one or more of these four conditions is not met, you are not authorized to use this site and place an order.

Order

after placing your order, we will send you an email confirming it. You can track your order on the site www.Fontenay.Paris.Com in the “track your order” section.

Your order will include an invoice in euros that you can also download after receipt in the “my orders” section.

Case & box

each watch purchased is systematically accompanied by a case and a warranty certificate marked by the brand.

Price, availability, delivery, and customs

Price

the prices displayed on the site are indicated in euros, including all french taxes (european vat and other applicable taxes), including:

• processing fees for your order
• all packaging costs, including the cases in which each ordered watch will be delivered

we reserve the right to change our prices without notice and at any time. Products already ordered will be invoiced according to the rates at the time of your order registration.

Despite all our efforts, some products on our site may have a pricing error.

The “store prices” displayed on the site correspond to prices found in stores in france for identical products or prices at which we believe a comparable product would be offered by a store in france based on our price evaluation methods. In no case does this indicative price bind our responsibility.

Availability & delivery

we inform you of the standard delivery date on the site on each product’s information page. In case of size or reference change once your initial order is validated and paid, the delivery date indicated during your purchase and in your account is no longer valid and will have to be reevaluated by customer service once your modification request has been taken into account by the latter. We do not guarantee delivery on the date related to the first choice of the watch since the change of reference or size may cause a delay in the usual manufacturing and delivery process.

Products ordered by the customer will be shipped in mainland france and european countries within 2 business days from the order. To this preparation time is added the processing and routing time to the address indicated by the customer when ordering on the website www.Fontenay.Paris

the seller commits to making its best efforts to deliver the products ordered by the customer within the deadlines specified above. However, these deadlines are provided for information purposes. However, if the products ordered have not been delivered within 30 days after the indicative delivery date for any reason other than force majeure or the customer’s fault, the sale can be resolved at the written request of the customer under the conditions provided for in articles l 216-2, l 216-3, and l 241-4 of the consumer code. The amounts paid by the customer will then be refunded at the latest within fourteen days following the contract termination date, excluding any compensation or withholding.

Customs duties for the european community

since orders are shipped from france, no customs duties apply to deliveries within the european community (excluding dom-tom).

You can make the payment by visa and mastercard credit card.

The information for making the payment (address, amount, order…) is indicated on the order confirmation pages and must be strictly followed for the order to be processed.

Payments by check or money order are not accepted.

Protection

Liability

we disclaim all liability if the delivered item does not comply with the legislation of the delivery country outside the european union.

We commit to providing all the care customary in the profession for the implementation of the service offered to the customer. However, our liability cannot be engaged in case of non-compliance with our contractual obligations due to a fortuitous event or force majeure as defined by the jurisprudence rendered by french courts.

Moreover, in case of non-substantial differences between the presentation photos of the items on our site, texts and illustrations, and the ordered items, our liability will not be engaged.

We use all available means to ensure the services subject to these general terms and conditions of sale. We are responsible for any direct and foreseeable damage at the time of using the site or concluding the sales contract between us and you; however, this compensation cannot exceed in any case the amount of the purchase concerned.

In no case shall we be liable for loss of profits, loss of business, loss of data, or loss of revenue, or any other indirect damage or which was not foreseeable at the time of using the site or concluding the sales contract between us and you.

Retention of title

the delivered goods will remain our property until you take physical possession and once you have paid the invoice amount.

Returns & withdrawal

fontenay paris’s priority is to satisfy you. You have an unconditional right of withdrawal of (14) fourteen calendar days after delivery on the items ordered in the online store without needing to justify it.

If you wish to exercise your right of withdrawal and cancel the sales contract, fontenay paris will refund the amount spent, except for the shipping costs of the ordered items which remain your responsibility, and provided that the products have not been worn or damaged and are returned in their original fontenay paris case, otherwise, they will be returned to you.

To exercise your right of withdrawal, you must communicate your decision to withdraw within 14 days after receiving your purchase by requesting the withdrawal form by email at and sending it back by post to the following address:

Returned items must be sent back in their original case.

Return shipping costs are your responsibility.

Upon receipt of your shipment, we will promptly refund your entire order except for any shipping costs. The refund will be made by bank transfer to the card used to pay the initial invoice. It is not possible to replace or exchange returned products. A new order must be placed online.
